Video shows public intoxication arrest of Oklahoma Secretary of State, Benjamin Lepak

Edmond, OK - The Edmond Police Department released the bodycam video showing the recent public intoxication arrest of Oklahoma Secretary of State Benjamin Lepak.
Around 10:45 p.m. on Aug. 14, police went to the McDonald's restaurant on North Kelly Avenue. They found a man, identified as Lepak, standing outside the fast-food restaurant holding a bag of food.
In the video, Lepak could be heard telling police that he had come from his home just a block away. The officer noted that Lepak appeared unstable on his feet and had slurred speech.
Lepak then told officers that he drove to the McDonald's after a church function. He initially denied having a drink but later told police he had less than one beer.
"I want to eat my McDonald's," Lepak told an officer. "My kids had been ... went to a new school tonight ... this week, and I went to the event with them. I've been eating healthy all week, so I got McDonald's because this is my night to have McDonald's, and that's it."
According to the police report, the officer said it was apparent that Lepak drove to the McDonald's and that he had "extremely slurred speech." The officer could also "smell an odor of an alcoholic beverage coming from his breath."
Lepak then volunteered to get an Uber from the location, which the police report said wouldn't be necessary if the Oklahoma secretary of state was not intoxicated.
The officer arrested Lepak about 10 minutes later for public intoxication, according to a police report. He was booked into the City of Edmond Jail.
While being put into handcuffs, the officer told Lepak that he was lucky that he wasn't being arrested for driving under the influence.
Gov. Kevin Stitt appointed Lepak as secretary of state in October 2025. Before being placed in the back of a police cruiser, Lepak told officers that he worked for the state but didn't say in what capacity.
