NY AG’s Office says officer ‘acted lawfully’ during deadly Buffalo traffic stop in July 2024

Buffalo, NY - No charges will be filed against a Buffalo Police Department officer in the deadly shooting of 29-year-old Daevon Roberts.

The New York State Attorney General’s Office of Special Investigations says the officer’s actions were justified under New York law.

On July 10, 2024, Roberts was stopped by two Buffalo Police officers as they claim he was speeding. The officers tried to verify Roberts’ license. When they couldn’t verify it, they opened his door and asked him to step out of the car.

Roberts’ didn’t get out of the car. In body-worn camera footage, it shows Roberts putting his car in drive and dragging the officer with him, and reaching for his gun before he was shot.

Roberts was brought to a hospital that night, where he was later pronounced dead.

The Office of Special Investigations said this case is now closed, and no charges will be filed.
