Former D.A.R.E. officer caught in on-duty sex scandal with teacher in classroom

Lebanon, TN - A former Lebanon police officer who once educated children on drug prevention as part of the D.A.R.E. program has lost his badge after an internal investigation revealed he engaged in sexual activity with an elementary school teacher—inside her classroom—while on duty.
An internal affairs investigation from the Lebanon Police Department concluded that Brian Gilley, previously assigned as a D.A.R.E. officer to Castle Heights Elementary School, had a sexual relationship with teacher Shelby Moss on school property after school hours.
The Lebanon Police Department said the incident took place after classes had ended in September 2024, but Gilley later acknowledged that students may still have been on campus at the time.
Initially, Gilley denied the allegations in an internal interview, telling investigators, “No, sir,” when asked whether any sexual contact occurred while on duty.
However, Gilley later admitted to the relationship and resigned soon after. There is no body camera footage of that September incident.
Body camera footage shows Gilley and Moss kissing while Gilley was in uniform and on duty, as cited in the department's findings.
The investigative report from Lebanon Police says Moss was married at the time of this relationship with Gilley.
While part of the body camera footage is blurred to protect the student, about two minutes before Gilley and Moss start kissing, a student walks into the classroom.
In an April 2025 decertification hearing, Gilley pleaded for leniency, saying, “I know I’ve done wrong, but I’ve also impacted that community in so many ways.”
“It was a mistake, and it will never happen again,” Gilley said during the proceedings. “I was very embarrassed.”
In May 2025, the Tennessee Peace Officer Standards and Training (POST) Commission voted to decertify Gilley, permanently banning him from serving in law enforcement in the state.
“You engaged in sexual activity at a school as an officer who was supposed to protect children,” said POST Executive Secretary William “Chip” Kain during the hearing.
Moss, the teacher involved, received a two-day suspension from the Lebanon Special School District, and later resigned in May.
The district has reported the incident to the Tennessee State Board of Education, which is now reviewing whether to impose additional consequences.
